Activity Terms and Conditions

General
Cardigan Bay Active organises and delivers adventurous activities though Adventure Beyond. We provide a schedule of available activities year round. Once you have made your booking and paid your deposit, your booking will be confirmed and you will be provided with all necessary information about your activity location. We do not provide transport to any of our activities.
1.1 Our contract with you
We agree to supply adventurous activity tours to you in exchange for payment at the advertised rate. No confirmed booking exists between CBA Ltd. and you, the client, until our receipt of your deposit has been acknowledged. Final balances must be settled by you at least two full weeks prior to your activity day. We reserve the right to re-sell your booking where your final activity payment remains outstanding within two weeks of the start of your activity.
1.2 Your Health and Safety
You are required to notify us in advance of any pre-existing medical conditions (medicated or otherwise), illnesses, disabilities which may require special consideration on the activity. We are always able to discuss with you any concerns you may have about your participation in any activity. At the start of each activity you will be required to sign and agree to the acceptance of risk statement (see 1.3) and record on this form any medical conditions which each individual may have.
1.3 Your acceptance of the risks
All outdoor sports and activities present varying degrees of inherent risk. Whilst we assess and manage much of this risk, we will not be held responsible for circumstances which arise from risks or occurrences reasonably outside our control. Prior to the start of each activity you will be required to sign in agreement to the acceptance of risk statement and also to agree that in your belief you are reasonably fit and able to participate in physical activity.
1.4 Liability and Insurance
We hold comprehensive public liability insurance with a benefit/indemnity cover of up to £10 million. We will not accept any liability for any damage to or loss of any personal effects owned by the client. We do not hold personal travel, injury or accident insurance and we are advised to inform you to take out this insurance with your own insurer.
1.5 Staff Instruction
Our staff are trained and qualified in the instruction of groups in the outdoors. By placing a booking on any of our activities, you agree to adhere to the instructions of our staff for your own safety and that of the group.
1.6 Minimum Numbers
All our activities run subject to minimum numbers of participants. Where we fail to reach a workable minimum, and you have an existing booking we will provide you with a credit note for another activity/time/date or refund of any monies paid.
1.7 Suitability of participants and minimum age requirements.
Minimum ages are given as a guide only. Our staff reserve the right to deny admission onto any activity where there may be concerns about the suitability of any individual's participation in that activity for any reason.
1.8 Alcohol and Drugs
Our staff reserve the right to deny people the right to go on activities if they believe they are under the influence of any substance, no refund, alternative dates or credit note will be given.
2.0 Making changes to your booking
Once your booking has been confirmed both you and ourselves have the opportunity to amend details of the booking subject to the following terms in point
2.1 - 2.3. All refunds are discretionary.
2.1 Changes due to weather and other variables
For your safety and enjoyment:
At times, the weather, tide, sea and river conditions may force us to change our plans for your activity booking, sometimes at short notice. We will endeavour to provide updates to changes to your booking immediately on your contact number/address provided at the point of booking (mobile number is best as this will be with you on holiday).
We will nearly always be able to provide you with an alternative activity which will be equally enjoyable, failing this we reschedule your session for a more suitable time or provide a credit note for future use.
We will not be held responsible for any failure by you to collect any message on your preferred contact.
2.2 If we change or cancel your booking
We reserve the right to make notified changes to your booking in order to provide a safe experience.
If we are unable to provide you with a suitable alternative activity, date or time we will provide a credit note.
Occasionally we may be forced to cancel your booking due to safety reasons or staff illness (which is extremely rare)
2.3 If you change, transfer or cancel your booking
Any refunds following your changes are awarded subject to cancellation period terms below. Our refund and activity transfer policy is outlined in the following table and is discretionary in all cases:
There is a 30% deposit required at booking to confirm your place, this is non refundable. With the balance to be paid 1 month before the activity.

3.1 If you have a complaint or feedback
We aim to please and welcome your feedback in all circumstances. Please provide details of your complaint in writing to us within 14 days of your activity to ensure issues can be followed up in a timely manner.
3.2 Pricing
Our current prices are always available to view on our pricing page. Out of date published prices will not be honoured. We reserve the right to change our prices at any time. Your confirmed booking will follow the quoted (initial) price regardless of increases.
3.3 Travel and Timing
Please allow sufficient time to arrive for your activity, call 01239 612 133 if you are running late or will not be attending. Occasionally activities may run late due to different causes, we will never shorten the duration of an activity we can run because of this. We do not provide refunds for delays and reserve the right to refuse those arriving late where activities have started to take place, with different people booking onto the same session we are unable to hold sessions times back waiting for part of the group as this will ruin others peoples activity.
